How Utah Defines DUI 

Utah's definition of DUI includes:

  • Driving with a blood alcohol concentration of .08 or higher
  • Driving while under the influence of drugs, such as marijuana or prescription medications

What Happens If You Refuse a Blood or Breath Test?

First-Time DUI Penalties in Utah

For those with no prior DUI offenses, a first-time conviction in Utah may include:

  • Jail time (between two and 180 days, though community service is often an option instead of jail time)
  • Fines between $700 and $1,000
  • Driver's license suspension of 120 days

The penalties are greater for those whose BAC was .16 or higher at the time of arrest. These enhanced penalties include a mandatory minimum of five days in jail and the mandatory use of an ignition interlock device (IID).
