Ways to Fight a DUI Charge

There are several options to contest a DUI charge, but one of the most basic is this—what if you weren’t really intoxicated, but the test came back with what’s called a “false high”? It might sound too good to be true, but it does happen, and for reasons that are more common than many people realize.

The foods we eat can impact the results a breathalyzer test will produce. Sugar and bread are notorious for helping to produce false highs. Were you eating pretzels or pizza as you watched the game and had a beer at The Break Sports Grill? That could trigger a false high. Or, maybe after your nice dinner out at The Wild Rose, you had some cake for dessert. That could make the glass of wine you had with dinner appear worse than it really is.

These are just two commonplace options. Medications, including mouthwash, can impact BAC levels. Common health conditions, including acid reflux, can have the same impact. It’s imperative that you have a lawyer who understands the possible reasons your BAC level could have come back higher than it should have.

We also examine the legitimacy of the stop itself. Unless you were stopped at a designated sobriety checkpoint, the arresting officer has to have had a good reason—known officially as probable cause—to pull you over and then administer the test.
