Our founder, Attorney William Melton, is a member of the National College of DUI Attorneys, and we have extensive experience helping people fight these kinds of charges. The state of Utah has the lowest threshold for DUI anywhere in the country—it only takes a blood-alcohol content (BAC) level of 0.05% to be over the legal limit and subject to criminal penalties that can include jail time.
We know there are a multitude of ways to challenge DUI cases, starting with the legality of the initial traffic stop. We also know that the low BAC threshold we have in Utah means that any errors by law enforcement in how they used the breathalyzer equipment or handled the blood test can easily lead to an inaccurate reading. The same goes for common foods and medical conditions—things as basic as consuming bread and sugar or dealing with acid reflux can “deceive” a breathalyzer into thinking someone is intoxicated.
